CandyGame makes no representations or warranties regarding the games, content, or services provided by third parties. You acknowledge that your use of the Service and any reliance on its content is at your sole risk.

8. Limitation of Liability

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination:

Your right to use the Service will immediately cease
Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate these Terms at any time by discontinuing your use of the Service and clearing any locally stored data from your browser.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CandyGame operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:

Informal Resolution: Before filing any formal legal claim, you agree to contact us first and attempt to resolve the dispute informally. We will try to resolve the dispute by contacting you via email.
Arbitration: If the dispute cannot be resolved informally within 30 days, it shall be resolved by binding arbitration in accordance with the rules of the applicable arbitration association.
Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or it is permanently barred.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you must discontinue your use of the Service.

13. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and CandyGame regarding the Service and supersede all prior agreements and understandings.
Force Majeure: Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, war, terrorism, civil unrest, natural disasters, governmental actions, and internet service disruptions.
